Tests of Highest and Best Use

For a property to be the highest and best use, it must meet all of the following tests.  The use must be:

 

1. Legally permissible

2. Physically possible

3. Economically feasible

4. Maximally productive

 

Many uses may be legal, possible, and feasible but only one will be maximally productive.
